Terms of Service

1. Acceptance of these Terms

These Terms of Service (“Terms”) govern your use of the Wagter mobile app, website, and related services (the “Service”). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Wagter is operated by Benni Christober Christoper Rajan. If Wagter’s legal operator changes, these Terms will apply to the successor or applicable operating entity. Contact: support@wagters.com.

2. Eligibility and account responsibility

• You must be at least 18 years old to use Wagter.
• You are responsible for the accuracy of account information and for activity under your account.
• You may not impersonate another person, create misleading accounts, bypass restrictions, or use another account without permission.
• We may suspend, restrict, or terminate accounts where needed for safety, legal compliance, abuse prevention, or policy enforcement.

3. User content and upload responsibility

You keep ownership of content you create and upload. By uploading or posting content, you grant Wagter a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, resize, adapt, display, distribute, moderate, and make available that content only as reasonably necessary to operate, secure, improve, and provide the Service.

You are solely responsible for the content you upload, including photos, videos, stories, reels, captions, comments, adoption listings, chat messages, profile details, reports, and any other material you submit.

You represent and warrant that:

• you own the content or have all necessary rights, licenses, permissions, and consents to upload it;
• your content does not infringe copyright, trademark, privacy, publicity, contract, animal welfare, wildlife, or other rights;
• your content does not violate applicable law or these Terms; and
• you will not upload downloaded, copied, watermarked, scraped, reposted, or third-party media unless you have permission to do so.

4. Prohibited content and conduct

You may not use Wagter to post, share, promote, request, sell, or engage in content or conduct that includes:

• copyright, trademark, privacy, publicity, or other rights violations;
• illegal activity, fraud, scams, phishing, deceptive listings, or misleading identity claims;
• harassment, bullying, stalking, threats, intimidation, hate speech, or abusive behavior;
• sexual exploitation, adult sexual content, child sexual abuse or exploitation, grooming, or sexualized conduct involving minors;
• graphic violence, glorification of violence, animal cruelty, animal abuse, or content encouraging harm to animals;
• illegal wildlife trade, trafficking, poaching, unsafe wildlife handling, or content promoting harm to wildlife or habitats;
• spam, fake engagement, scraping, abusive automation, malware, security attacks, or attempts to overload the Service;
• attempts to bypass moderation, upload checks, rate limits, bans, restrictions, safety systems, or enforcement controls;
• false, malicious, or abusive reporting;
• misuse of trusted-creator, limited-access, testing, or creator-only features; or
• any content or conduct we reasonably believe is unsafe, unlawful, abusive, deceptive, or inconsistent with Wagter’s pet and wildlife purpose.

5. Copyright, IP complaints, and repeat infringement

If you believe content on Wagter infringes your copyright, trademark, or other intellectual property rights, submit a notice through Copyright & IP Policy or email support@wagters.com.

We may remove or restrict allegedly infringing content, limit access, preserve relevant information, request additional details, or take account action. Users who repeatedly upload infringing or unauthorized content may have content removed, features restricted, accounts suspended, or accounts permanently terminated.

Submitting false or bad-faith IP claims or counter-notices may lead to enforcement action and may have legal consequences.

6. Adoption listings and adoption chat

Wagter may allow users to create adoption listings, send adoption interest, and communicate through adoption-related chat features. Wagter is a platform for communication and discovery. Wagter is not an animal shelter, veterinary service, rescue organization, breeder, broker, escrow service, payment processor, or adoption guarantor.

Users are responsible for verifying all adoption information, including animal identity, ownership, health, vaccination status, behavior, microchip details, legal transfer, and suitability. Wagter does not guarantee that listings, users, animal details, ownership claims, medical information, or adoption outcomes are accurate or safe.

• Do not send deposits, transport fees, reservation fees, or other payments before independent verification.
• Meet safely in public or appropriate supervised locations where possible.
• Confirm identity, ownership, animal health, and local legal requirements before any transfer.
• Do not list or transfer animals illegally, deceptively, or in a way that harms animal welfare.
• Use in-app reporting and blocking tools for suspicious listings, unsafe behavior, scams, or harassment.

7. Privacy, moderation, and safety review

Your use of the Service is also governed by our Privacy Policy. To operate and protect Wagter, we may use automated systems, user reports, metadata review, and human review where appropriate to detect spam, abuse, fraud, policy violations, safety risks, illegal content, and rights violations.

We may review content, account information, upload metadata, messages, adoption listings, reports, and related activity as reasonably necessary for safety, support, legal compliance, and enforcement.

8. Reports, blocking, private accounts, and user controls

Wagter may provide reporting, blocking, muting, restricting, private-account, follow-request, and deletion controls. These tools are provided to improve user control and platform safety. You may not misuse them through false, malicious, automated, or bad-faith activity.

Private accounts and blocking tools reduce visibility inside the Service, but users who can access content may still capture, copy, or reshare it outside the Service. Upload only content you are comfortable sharing according to your settings.

9. Enforcement

We may investigate and act on content, accounts, listings, chats, and behavior that we believe may violate these Terms, law, user safety, animal welfare, or the integrity of the Service.

• remove content, listings, comments, stories, reels, or messages;
• limit visibility or distribution;
• disable, restrict, or revoke features;
• require additional review;
• archive, preserve, or disclose information where legally required or safety-critical;
• suspend or permanently terminate accounts; and
• report serious illegal activity to appropriate authorities where required or appropriate.

We may take action without prior notice where necessary for safety, legal compliance, fraud prevention, abuse prevention, or protection of users, animals, wildlife communities, or the Service.

10. Third-party services and links

The Service may rely on third-party providers for authentication, hosting, storage, content delivery, app distribution, notifications, analytics, diagnostics, moderation support, support forms, and security. Third-party links or services may be subject to their own terms and policies.

11. Wagter intellectual property

The Service, excluding user content, includes software, branding, designs, text, graphics, icons, user interface elements, logos, and other materials owned by or licensed to Wagter. You may not copy, modify, distribute, reverse engineer, scrape, or exploit the Service except as permitted by law or with written permission.

12. Disclaimers and limitation of liability

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Wagter does not guarantee uninterrupted availability, error-free operation, permanent availability of content, successful adoption outcomes, user identity, listing accuracy, animal health, or that the Service will always be secure or free from harmful components.

To the maximum extent permitted by law, Wagter will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, opportunities, adoption outcomes, offline incidents, user-uploaded content, or third-party conduct. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Account deletion, termination, and survival

You may request account deletion through the app or at Delete account. Deletion is intended to be permanent once completed. Some limited information may be retained where required or reasonably necessary for legal, safety, security, fraud-prevention, abuse-prevention, or rights-enforcement reasons.

Sections that by their nature should survive termination will continue to apply, including content licenses, user responsibility, intellectual property, disclaimers, limitations of liability, adoption disclaimers, enforcement, and legal compliance.

14. Changes and contact

We may update these Terms from time to time. If we make material changes, we may provide notice through the Service or other appropriate means. Continued use of the Service after updated Terms become effective means you accept the updated Terms.
